Terms of Service

These Terms of Service govern your use of MyPrechart at myprechart.co. By creating an account you agree to these terms.
The Service
MyPrechart is an AI-powered documentation assistance tool for licensed home health clinicians. The service uses Claude AI by Anthropic, accessed through AWS Bedrock, to generate suggested home health visit documentation and nursing narratives structured for home health documentation requirements, based on the clinical notes you provide. MyPrechart does not provide medical advice, clinical recommendations, diagnoses, or treatment decisions, and does not guarantee the clinical accuracy of any generated content. All AI-generated output must be reviewed, verified, edited as needed, and signed by the licensed clinician of record before it is used in any clinical record or submitted to Medicare or any other payer. The clinician of record is solely responsible for all documentation they submit.
Eligibility
You must be 18 years or older and a currently licensed healthcare professional in good standing to use MyPrechart. By using the service you represent that your license is active and that you will use MyPrechart only for lawful professional documentation purposes within your scope of practice.
Documentation Responsibility
MyPrechart is a documentation support tool. It does not provide clinical, legal, billing, or regulatory advice. All documentation generated through MyPrechart must be reviewed, verified, and approved by the licensed clinician before entry into any clinical record. The clinician remains the author of record and is solely responsible for the accuracy, completeness, and regulatory compliance of all documentation. MyPrechart makes no representation or warranty that documentation will satisfy any payer, regulatory, or accreditation requirement.
Patient Privacy and PHI Handling
Enter only the minimum patient information necessary to generate your documentation. New clinical work is held only in current-session memory. MyPrechart is not a system of record. There is no server-side copy of your clinical documentation of any kind, short-lived or otherwise. Clinical content you enter passes through our AWS processing infrastructure in memory only for the purpose of generating your narrative and is not written to any database or log. Reloading, closing the app, signing out, or changing accounts removes new clinical work. Copy finished notes into your EMR before leaving. Older device records remain unchanged during this upgrade and are available through explicit recovery; they are not sent automatically. A HIPAA Business Associate Agreement (BAA) is in place with our cloud infrastructure provider, Amazon Web Services. Wound care photos uploaded through the Wound Care Reference feature transit the AI for analysis only and are never written to or stored in our database. MyPrechart does not automatically detect, strip, or scrub patient identifiers from the text you enter. No user content is used to train any AI model. You remain responsible for compliance with HIPAA, Medicare documentation requirements, and any other applicable federal or state privacy and healthcare laws in your use of this service.
Device Storage and Data Responsibility
Local storage of clinical data. Clinical documentation you create in MyPrechart is stored only on the device you are working on, in the app's local database. There is no server-side copy of your clinical documentation of any kind, short-lived or otherwise; MyPrechart does not retain or maintain copies of your clinical documentation on its servers, and protected health information passes through our processing infrastructure only in transit.
No backup or recovery by MyPrechart. Because your clinical documentation is held on your device only, MyPrechart cannot back it up, restore it, or recover it. If your device is lost, stolen, damaged, reset, or if the application is uninstalled, your locally stored clinical documentation will be permanently lost. MyPrechart has no ability to retrieve it. You are responsible for entering completed documentation into your employer's system of record and should not rely on MyPrechart as a system of record or as a retention mechanism.
Device security requirements. As a condition of using MyPrechart, you must enable a device passcode or biometric lock and platform full-disk encryption (such as FileVault, BitLocker, or the equivalent iOS device encryption) on any device on which you use the application. You must not use MyPrechart on a shared, jailbroken, or rooted device. MyPrechart does not detect, verify, or enforce these protections, and cannot confirm whether they are enabled on your device; responsibility for enabling and maintaining them is yours. The optional in-app biometric lock offered in the iOS application is an additional convenience control only. It is disabled by default, resets to disabled if the application is reinstalled or you move to a new device, is not available in the web application, and is not a substitute for device encryption. Failure to maintain these protections may increase the risk of unauthorized access to protected health information. Users are responsible for maintaining the security of their devices and credentials and should promptly report any suspected unauthorized access or disclosure to their employer or other applicable privacy or security contact.
Deletion of local data. The application provides functionality allowing you to delete locally stored clinical data. Upon termination of your subscription, or at the direction of your employer, you are responsible for deleting locally stored clinical data in accordance with your employer's retention and disposal requirements. MyPrechart cannot access or verify deletion of data stored on your device.
Your employer's obligations. If you use MyPrechart in connection with patient care, your employer is the covered entity under HIPAA and is responsible for the availability, retention, and disposal of clinical records, for responding to individual rights requests, and for breach notification to individuals, the media, and the Department of Health and Human Services. MyPrechart acts solely as a business associate.
Subscription and Billing
MyPrechart offers a free trial of 30 narratives with no credit card required. After your free trial you may subscribe to the Individual plan on a monthly basis (on the MyPrechart website or inside the iOS app) or on an annual basis (inside the iOS app); both Individual options renew automatically — monthly subscriptions each month, annual subscriptions each year. The Team plan is offered at custom per-seat pricing provided directly by MyPrechart (minimum of 3 seats) and is available only through the MyPrechart website or by contacting MyPrechart directly; the Team plan is not offered for purchase inside the iOS app. The price you pay is the one shown at the point of purchase: inside the iOS app that is Apple's localized App Store price, and on the MyPrechart website it is the price listed at checkout. Subscriptions renew automatically until cancelled, and you may cancel at any time.
Where you subscribe determines who bills you and where you cancel. Subscriptions purchased on the MyPrechart website are processed by Stripe and managed from account settings. Subscriptions purchased inside the MyPrechart iOS app are in-app purchases billed by Apple to your Apple ID; they renew unless cancelled at least 24 hours before the end of the current period, and they are cancelled in Settings on your device under your name, then Subscriptions. Deleting your MyPrechart account does not cancel an Apple subscription. Refunds for Apple purchases are handled by Apple under its own policies.
Team Plan and Seat Management
On the Team plan, the account owner (typically the agency or organization) is the responsible billing party for all seats on the account. The account owner manages seats, including adding and removing users, and is responsible for ensuring that every user invited to a seat is a licensed healthcare professional eligible to use the service. The account owner is responsible for all activity, charges, and compliance obligations associated with every seat on the account.
Refunds
If you subscribed on the MyPrechart website and are not satisfied within the first 7 days of a paid subscription, contact info@myprechart.co for a full refund. After 7 days all website payments are non-refundable. Purchases made inside the iOS app are billed by Apple, and refunds for them are requested from and decided by Apple under its own policies — we cannot issue them.
Deleting your account cancels a subscription we bill immediately. The remainder of a period you have already paid for is not refunded, and an Apple subscription must be cancelled by you in Settings on your iPhone.
Acceptable Use
You may not use MyPrechart to generate fraudulent clinical documentation, misrepresent clinical findings, bill for services not rendered, or violate any applicable law or regulation, including Medicare documentation rules and HIPAA. We reserve the right to suspend or terminate accounts that violate these terms.
Disclaimer of Warranties
MyPrechart is provided as is without warranties of any kind. We do not guarantee the clinical accuracy of generated narratives or that they will meet any specific regulatory or payer requirement. You are responsible for reviewing, verifying, and signing all content before submitting it in any clinical record or to any payer.
No Allocation of Legal Obligations
Nothing in these Terms determines or allocates responsibility for any breach notification or other legal obligation that may arise under applicable law. Such obligations will be determined based on the parties' respective roles, agreements, and applicable law.
Limitation of Liability
MyPrechart shall not be liable for any clinical decisions made based on AI generated content, any regulatory penalties, audit findings, or claim denials, or any indirect or consequential damages arising from your use of the service.
Changes to Terms
We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
